Collecting societies are nongovernmental organizations that serve to protect the rights of copyright holders by eliminating the difficulty of those who want to use intellectual rights to reach them through collective rights management. Collective rights management, which is the most important feature of collecting societies, is the followup of rights that are suitable for this by collecting societies, thanks to an authority of given to collecting societies. Collecting societies make license agreements with third parties regarding the rights authorized by their members, file infringement lawsuits against those who use works without an agreement, and distribute the money collected through these agreements and cases to its members in line with the price distribution directive of the relevant collecting societies. Thus, it becomes easier for third parties to reach the copyright owner, and finally, agreements are made with more users than right owners can agree for themselves. In this respect, the collective rights tracking system is a system that facilitates the process for both the right holder and the third parties who want to benefit from the copyrighted work. Within the framework of this idea, with the Law amendments made in 2001 and 2004, collecting societies and collective rights followup system became a part of Turkish Law. With Regulation on Certificate of Authorization to be Given to Collecting Societies, which entered into force on 07.11.2020 and Regulation of Collecting Societies in the Field of Copyrights, which entered into force on 06.04.2022, the system was tried to be fully shaped in Turkey. Within the scope of these regulations; the legal basis of collective rights enforcement, the certificate of authorization and the legal nature of the legal followup relationship; the characteristics of collective rights followup; and the limits of the collective rights followup authority of the collecting societies will be tried to be determined.
