213 Sayılı Vergi Usul Kanunu Çerçevesinde Hazine ve Maliye Bakanlığının Takdir Yetkisi Hakkında Bir Değerlendirme

Özet

1 No.lu Cumhurbaşkanlığı Teşkilatı Hakkında Cumhurbaşkanlığı Kararnamesi (Cumhurbaşkanlığı Kararname) ile idarî bir organ olan Hazine ve Maliye Bakanlığı (Bakanlık) teşekkül etmiştir. Cumhurbaşkanlığı Kararnamesi’nin 217. maddesinde Bakanlığın görev ve yetkileri düzenlenmiştir. Bu görev ve yetkilerin bir kısmı, bir kamu gelir türü olan ve Anayasa’nın 73. maddesinde bir ödev olarak hükme bağlanan vergi ile doğrudan ya da dolaylı ilgilidir. Ayrıca Cumhurbaşkanlığı Kararnamesi’nin madde 217/1-s hükmü uyarınca Bakanlık, bu Kararname dışında kanunlarla veya Cumhurbaşkanlığı kararnameleriyle verilen diğer görevleri de yapmaktadır. Bu kanunlardan birisinin de vergi hukuku mevzuatında temel vergi hukuku niteliğini haiz 213 sayılı Vergi Usul Kanunu (VUK) olduğu görülmektedir. İdarenin bazı sebepler gerçekleştiğinde bazı işlemleri yapmak zorunda olmadığında takdir yetkisinden, yapmak zorunda olduğunda ise bağlı yetkisinden bahsedilmektedir. İdarî yetkilerin büyük bir bölümünü bağlı yetki oluşturmakta ise de VUK kapsamında idarî yetkili olarak teşekkül eden Bakanlığın bağlı yetkisinin dışında; takdir yetkisinin bulunduğu birçok hukukî duruma ilişkin düzenlemenin de mevcut olduğu görülmektedir. Takdir yetkisi, idarenin hukuka bağlılığının bir istisnasını teşkil etmemektedir; yine bir hukuk kuralından doğmakta olup hukuk kuralları içindeki hareket özgürlüğünü ifade etmektedir. Takdir yetkisinin hukuka aykırı kullanılışında takdir sakatlığı; ihtiyaca aykırı kullanılışında takdir isabetsizliği ortaya çıkmaktadır. İdareye tanınan takdir yetkisi, kamu yararı ve kamu hizmetinin gerekleriyle sınırlıdır ve bu açıdan yargı denetimine tabidir. Takdir yetkisinin hukuka aykırı kullanımını ifade eden takdir sakatlığında bu yetkinin, kamu yararı ve kamu hizmetinin gereklerine göre kullanılmadığı tespit edilmektedir. Diğer taraftan takdir isabetsizliği, Anayasa’nın madde 125/4 hükmü uyarınca yerindelik denetimi yasağı kapsamında kaldığından yargısal denetime tabi değildir. Bu çalışmada, Bakanlığın VUK kapsamındaki takdir yetkisinin incelenmesinde, VUK’un kitapları temelinde tarafımızca tasnif geliştirilmiştir. Bu bağlamda VUK’un beş kitabının kapsamındaki düzenlemelerde de Bakanlığa takdir yetkisinin verildiği görülmektedir. Verginin kanunîliği ilkesinin içeriğindeki unsurlardan birisi de vergisel ödev ve vergisel usul ilişkilerini düzenleyen temel ögelerdir. Bu noktada, bahsi geçen ilke içeriğindeki unsurlarda, Bakanlığın VUK hükümleri çerçevesinde takdir yetkisinin bulunduğu tespit edilmiştir. VUK düzenlemelerinde Bakanlığın takdir yetkisi kapsamındaki vergisel durumların bir tespitinin yapılması, akabinde bunların tasnif edilerek listelenmesi ve yargısal denetim açısından sadece kamu yararı ve kamu hizmetinin gereklerine göre kullanılıp kullanılmadığı denetlenebilecek konuların ortaya çıkarılması, bu çalışmanın amacını oluşturmaktadır. 

The Ministry of Treasury and Finance (The Ministry), an administrative body, was established by Presidential Decree No. 1 on the Presidential Organization (The Presidential Decree). The duties and authorities of the Ministry are regulated in Article 217 of the Presidential Decree. Some of these duties and authorities are directly or indirectly related to the tax, which is a public revenue type and is stipulated as a duty in Article 73 of the Constitution. In addition, in accordance with the provision of Article 217/1-s of the Presidential Decree, the Ministry also performs other duties given by laws or Presidential decrees other than this Decree. It is seen that one of these laws is the Tax Procedure Law No. 213 (TPL), which has the characteristic of the basic tax law in the tax law legislation. It is mentioned that the administration has discretionary authority when it is not obliged to perform some tarnsactions when certain reasons occur, and its dependent authority when it is obliged to do so. Although most of the administrative authorities are dependent authority, apart from the dependent authority of the Ministry, which is formed as an administrative authority within the scope of the TPL; it is seen that there are regulations regarding many legal situations in which there is discretionary authority. The discretionary authority arises from a rule of law and expresses the freedom of action within the legal rules. However, it is not an exception for the administration’s commitment to the law. If the discretionary authority is used unlawfully, discretionary disability; is used contrary to the need, inaccuracy of discretion occurs. The discretionary authority granted to the administration is limited to the public interest and requirements of the public service and is subject to judicial review in this respect. In case of discretionary disability, which expresses the unlawful use of discretionary authority, it is determined that this authority is not used in accordance with the requirements of the public interest and public service. On the other hand, the inaccuracy of discretion is not subject to judicial review as it falls within the scope of the prohibition of appropriateness control in accordance with the provision of article 125/4 of the Constitution. In this study, in examining the discretionary authority of the Ministry within the scope of the TPL, a classification has been developed by us on the basis of the TPL’s books. In this context, it is seen that the Ministry has the discretionary authority in the regulations within the scope of the five books of the TPL. One of the elements in the content of the principle of legality of tax is the basic elements that regulate the tax duties and tax procedure relations. It has been determined that the Ministry has discretionary authority within the framework of the provisions of the TPL regarding the elements within the content of the aforementioned principle. The purpose of this study is to make a determination of the tax situations within the scope of the discretionary authority of the Ministry in the TPL regulations, then to classify and list them, and to reveal the issues that can only be audited in terms of judicial review whether they are used according to the requirements of the public interest and public service.
