Asıl dayanağının dürüstlük kuralı olduğu düşünülen sigortacının aydınlatma yükümlülüğü, 6102
Sayılı Türk Ticaret Kanunu’nda (TTK) somut olarak
düzenlenerek normatif bir kural olma özelliğini kazanmıştır. Çok teknik bir sözleşme tipi olan sigorta
sözleşmelerinde, sigortacının güçlü konumu sebebiyle,
sigorta ettireni koruma güdüsüyle hareket eden kanun
koyucu, aydınlatma yükümlülüğüne ilişkin kuralları
da belirlemiştir. Ayrıca bu yükümlülüğün şekil ve
içeriğini belirleyecek yönetmelik çıkarmak hususunda
da idareye açıkça yetki vermiştir. Bunun yanında söz
konusu yükümlülüğe aykırı davranılması halinde
oluşacak hukuki sonuç da TTK’da düzenlenmiş olup
bu düzenleme, doktrinde, ulaşılmak istenen amaca
yeterince uygun olmadığı gerekçesiyle eleştirilmiştir.
Sigortacının aydınlatma yükümlülüğüne aykırı davranması halinde ortaya çıkacak olan hukuki sonucun
kanun ve yönetmelikte farklı düzenlenmesi, uygulamada karışıklığa yol açmakta ve farklı mahkemelerde
birbirlerine uyumlu olmayan kararlar verilmektedir.
İşbu çalışmada, sigortacının aydınlatma yükümlülüğüne aykırı davrandığı bir olay hakkında verilen
mahkeme kararı incelenmiş ve mahkemenin verdiği
karar hukuki açıdan değerlendirilmiştir.
The information duty of the insurer, which
main basis is considered to be the principle of honesty,
has been regulated concretely in the Turkish Commercial Code (TCC) numbered 6102 and has become a
normative rule. In the insurance contract, which is a
very technical contract type, due to the strong position
of the insurer, the lawmaker, acting with the motive to
protect the insurer, has determined the rules regarding
the information duty and also explicitly authorized the
administration to issue instructions to determine the
form and content of this duty. In addition, the legal
consequences that will arise in case of violation of the
duty in question are regulated in the TCC, and this
regulation has been criticized in the doctrine on the
grounds that it is not adequately suitable for the purpose to be achieved. The different regulations in the act
and the guidelines regarding the results of failure to
information duty of insurer cause confusion in the
implementation and the different courts render incompatible verdicts. In this article, a court decision on
the case that the insurer failed to comply with information duty has been examined and the court decision
has been evaluated from the legal perspective.
