Abstract
Each contract establishes a relationship based on trust, securing the obligations between the parties. Therefore, the fulfilment of obligations arising from the contract not only regulates the debt relationship between the parties but also strengthens the sense of trust between individuals. A debtor's failure to fulfil their contractual obligations on time, despite having the means to do so, is a legal problem that can cause material and moral damage to the creditor, both in their personal life and in their commercial activities. It is important to find a solution to this problem in order to remedy the damage suffered. Looking at classical Islamic jurisprudence, it is seen that debtors who breach their contractual obligations are subject to physical and liberty-restricting penalties such as imprisonment and corporal punishment, rather than financial penalties. However, the non-financial penalties imposed on those who breach their contractual obligations aim to prevent the debtor from repeating this behaviour in the future, rather than compensating the creditor for their loss. For this reason, penalties that are not financial in nature and do not directly compensate the creditor for their loss do not offer a solution to remedy the harm suffered. Therefore, it is important to find a solution to contractual breach issues that ensures justice between the parties. Taking into account the changing economic conditions and seeking solutions to the grievances caused by breaches of contract, contemporary jurists have envisaged financial penalties for those who fail to fulfil their debts on time in order to prevent breaches of contract. However, this proposed solution has sparked debates among jurists regarding the permissibility of imposing financial penalties. At the centre of the debate are differing views on whether financial penalties fall within the scope of riba, an act deemed unlawful by Allah. This study will examine the processes for compensating for damages arising from the deliberate failure to fulfil debts on time and the financial penalties envisaged for offenders. The primary aim of this study is to examine views on the financial penalties prescribed for those who breach contractual obligations within the framework of the general principles of Islamic jurisprudence. In this regard, the objective is to propose a concrete solution by defining the limits of a financial penalty system that remedies the harm caused by such breaches and ensures justice between the parties. The findings reveal that there is a difference of opinion among jurists regarding the permissibility of financial penalties. While some jurists do not consider financial penalties permissible due to concerns about usury, some jurists have stated that financial penalties for the purposes of compensation and deterrence are permissible, taking into account the material and moral damages suffered by the creditor. Among the jurists who express the view that the imposition of a financial penalty is permissible, there are differing approaches regarding the legal nature of this penalty, the types of contracts in which it may be demanded, and where the collected amount should be used. The study concluded that, as a penalty for individuals who commit offences by breaching their contractual obligations, a method should be applied whereby the debtor hands over to the creditor property equivalent in value to the amount of the debt, and the creditor retains this property for as long as the payment remains outstanding, returning it to the debtor once the period has elapsed. It is considered that this solution is the most appropriate option for establishing fairness between the parties.
