Özet

Savaş tarihi boyunca, yeni silahlar ve teknolojiler sıklıkla ortaya çıkmıştır. Savaş yeteneklerinin geliştirilmesi, yeni teknolojilerin kullanımı ve ateş gücünün artırılması orduların temel kaygıları olmuştur. 1800’lü yıllarda başlayan buluşlar döneminde1, buhar makinelerinin ve petrol gibi yeni yakıtların kullanımı, kıtalararası ulaşımı, daha uzak mesafelere ulaşmayı; metallerin işlenmesi, tüfeğin, kısa süre sonra makineli tüfeğin ve zırhlı gemilerin yapılmasını sağlayacaktır. 1840’ta telefon-telsiz-telgrafın kullanımı, 1852’de Henri Giffard’ın ilk başarısız hava gemisi denemesi gerçekleşir. Bir yıl sonra George Kayley başarılı bir planör uçuşu gerçekleştirir. XX. yüzyıl yaklaşırken, teknolojinin muazzam başarılarına rağmen, hammadde ve kullanım kaygıları sonraki on yılları şekillendirecek yeni tartışmaları tetikleyecektir. Budiansky, XX. yüzyılın ilk çeyreğini mucizeler çağı olarak tanımlar, çünkü bu yüzyıl ‘dönüşüm’ çağıdır: elektriğin keşfini takip eden yıllarda sadece günlük kullanıma özgü icatlar değil, aynı zamanda savaş alanını etkileyecek değişimler de ortaya çıkacaktır.

XX. yüzyılın ilk yarısına hâkim olan siyasi gerilimler ve yaşanan çatışmalar, bir taraftan daha üstün silahlar yaratma arzusunu ve teknolojik gelişmeleri tetiklemiş; diğer taraftan, yüzyılın ikinci yarısına yön verecek olan savaşları düzenleyen normları derinden etkilemiştir.XX. yüzyılın ikinci yarısında savaşların aktörleri, yöntemleri, teknolojileri, gereksinimleri, hatta isimleri değişirken, savaşa ilişkin kurallar aynı kalmıştır.

Teknolojiyi üreten ve ona sahip olanlar ile üretemeyen ve sahip olamayanlar arasında oluşan asimetri, XX. yüzyılın son çeyreğine ve XXI. yüzyılın başında silahlı çatışmalarının en belirleyici niteliklerinden biri haline gelirken, savaş yöntem ve araçları ile çatışmalar esnasında sivillerin korunmasına ilişkin uluslararası İnsancıl Hukuk kurallarını da zorlamaktadır. Modern hava kuvvetlerinin oluşumundan çok önce, neredeyse iki asırdan uzun bir süredir, günümüz hava araçları kadar gelişmiş olmasa da çeşitli hava unsurları silahlı çatışmalarda askeri amaçla kullanılmaktadır. Hava bombardımanını en yüksek etkiyle gerçekleştirmek için geliştirilen yeni teknoloji, hukukun uzanamadığı coğrafyalarda riskleri azalttığı düşünüldüğünden ‘modern’ çatışmaların vazgeçilmez unsurlarından biri haline gelmiştir.

1990’lı yıllardan itibaren, başta terörle mücadele olmak üzere, silahlı çatışmalarda hava kuvvetleri öne çıkmaya başlamıştır. Bu dönemde Çöl Fırtınası Harekâtı, hava kuvvetlerinin rolünü belirgin hale getiren harekâtlardan biri olmuştur. Gerçek zamanlı gözetleme ile elde edilen veri, yüksek hızda ve modern mühimmat kullanılarak gerçekleştirilen saldırılar, müttefik kara kuvvetlerinin kayıplarını minimumda tutarak, kısa sürede sonuç alınmasını sağlamıştır. Bu dönemde uygulanan nokta saldırıları, yıpratma yoluyla gerçekleştirilen klasik çöküşten ziyade, işlevsel etkilerin harekâtlarda öne çıktığını göstermektedir.

Özellikle hava harekâtlarında, silahlı çatışmaların yürütülmesine ilişkin temel ilkelere uygun hareket edilmesi, özellikle ayrım gözetme ve orantılılık ilkeleri temel tartışma noktaları oluşturmuş; bu ilkelerin,yakın dönemde tanık olunan askeri faaliyetlerde uygulama alanı bul(ama)ması, konuyu kamuoyu için olduğu kadar hukukçular için de merakla ve ilgiyle takip edilen bir başlık haline getirmiştir.

Silahlı çatışmaların hukuki boyutunu düzenleyen İnsancıl Hukuk’un bu temel ilkelerinin kapsamları ve uygulamaları, şüphesiz sonraki hava operasyonları bakımından açıklayıcı ve yol gösterici olacaktır. Bu anlamda Devlet pratiği ve algısının evrensel normlarla ne ölçüde uyumlu olduğuna bakılması faydalıdır. Bu çalışma hava savaşına ilişkin uygulamaların, Dünya Savaşlarından günümüze farklılaşan devlet uygulamalarının incelenmesi, doktrindeki tartışmaların takip edilmesi neticesinde oluşturulmuştur.

Silahlı Çatışmalar Hukuku’nu oluşturan Lahey Hukuku, Cenevre Hukuku ile sağlamlaştırılmaya çalışılmıştır. Hava gücünün kullanımına ilişkin ilk düzenlemeler de 20.yüzyılın ilk yarısında kaleme alınmıştır. Konu hakkında kaleme alınan ilk eserler, günümüzde hala tartışmalı olan noktaların, kuvvetin oluşum aşamasında dahi tartışmalı olduğunu göstermektedir. Bugün, ileri teknolojinin sunduğu imkânlara rağmen, aynı endişeler devam etmektedir. Bu sebeple erken dönemde konu hakkında çıkan ve tartışmalı olan hususlar öncelikle incelenmiştir.

İnsanlı platformlardan insansız platformlara geçişin, savaş alanındaki etkisi, fiili ve hukuki koşullar dikkate alınarak bir değerlendirme yapılmaya çalışılmıştır. Bu hususlardaki kemikleşmiş algıyı kırabildiği ve eksiklikleri tamamlayabildiği ölçüde çalışmamız amacına ulaşmış olacaktır.

Tez çalışmalarımın alt yapısını oluşturan araştırma süresinin bir yılı Hollanda’da ve Amerika Birleşik Devletleri’nde geçirilmiştir.

Throughout the history of warfare, new weapons and technologies have appeared frequently. Developing combat capabilities, using new technologies and increasing firepower have been the main concerns of armies. In the era of inventions that started in the 1800s, the use of steam engines and new fuels such as oil, intercontinental transportation, reaching longer distances; The processing of metals would enable the rifle, and soon the machine gun, and armoured ships to be made.

The use of the telephone radiotelegraph in 1840, Henri Giffard's first unsuccessful airship trial in 1852. A year later, George Kayley makes a successful glider flight. XX. As the century approaches, despite the tremendous achievements of technology, raw material and usage concerns will trigger new debates that will shape the next decades. Budiansky describes the first quarter of the twentieth century as the age of miracles because it is the age of 'transformation': in the years following the discovery of electricity, not only inventions for everyday use will occur, but also changes that will affect the battlefield.

The political tensions and conflicts that dominated the first half of the XX. century, on the one hand, triggered the desire to create superior weapons and technological developments; On the other hand, it deeply influenced the norms regulating the wars that would shape the second half of the century.
While the actors, methods, technologies, requirements and even the names of the wars changed in the second half of the twentieth century, the rules of war remained the same.

The asymmetry between those who produce technology and those who have it and those who cannot produce and cannot have it has reached the last quarter of the XX.th century and the XXI.th. While it has become one of the most defining features of the armed conflicts at the beginning of the century, it also challenges the international humanitarian law rules regarding the methods and tools of war and the protection of civilians during conflicts. Long before the formation of the modern air force, for more than two centuries, various air elements have been used for military purposes in armed conflicts, although not as advanced as today's aircraft. The new technology, developed to carry out an aerial bombardment with the highest effect, has become one of the indispensable elements of 'modern' conflicts, as it is thought to reduce risks in geographies where the law cannot reach.

Since the 1990s, the air force has come to the fore in armed conflicts, especially in the fight against terrorism. During this period, Operation Desert Storm was one of the operations that made the role of the air force clear. The attacks carried out using the data obtained by real-time surveillance, high speed and using modern ammunition, kept the losses of the allied ground forces to a minimum and ensured that results were obtained in a short time. The point attacks applied in this period show that the functional effects came to the fore in the operations rather than the classical collapse by attrition.

Acting in accordance with the basic principles regarding the conduct of armed conflicts, especially in air operations, especially the principles of discrimination and proportionality formed the main points of discussion; The fact that these principles did not find application in the military activities witnessed in the recent period has made the subject a topic that is followed with curiosity and interest by lawyers as well as the public.

The scope and application of these basic principles of Humanitarian Law, which regulates the legal dimension of armed conflicts, will undoubtedly be explanatory and guiding for future air operations. In this sense, it is useful to look at the extent to which State practise and perception are compatible with universal norms. This study was created as a result of examining the practices related to air warfare, the state practices that differed from the World Wars to the present, and following the discussions in the doctrine.

The Hague Law, which constitutes the Law of Armed Conflicts, has been tried to be consolidated with the Geneva Law. The first regulations on the use of airpower were also written in the first half of the 20th century. The first works written on the subject show that the points that are still controversial today are controversial even during the formation of the force. Today, despite the possibilities offered by advanced technology, the same concerns persist. For this reason, the issues that emerged and were controversial in the early period were primarily examined.

An evaluation has been made by considering the effect of the transition from manned platforms to unmanned platforms on the battlefield, as well as the actual and legal conditions. Our study will have achieved its purpose to the extent that it can break the ossified perception on these issues and complete the deficiencies.
