In today’s era, it has become a necessity for the administration to respond quickly to societal needs by using both its own resources and other resources within the country more effectively and efficiently, especially in light of the increasing population. The 1982 Constitution of the Republic of Türkiye, which defines the founding principles and foundations of the state, states in Article 5, titled “Basic Instruments and Duties of the State”, that the aims and duties of the state are to ensure the welfare, peace, and happiness of individuals and society; to remove economic and social obstacle that restrict the fundamental rights and freedoms of individuals in a manner incompatible with the principles of social law and justice; and to create the necessary conditions for the development of the material and spiritual well- being of humanity. The third section of the second part of the Constitution, titled “Fundamental Rights and Duties”, imposes a number of positive and negative obligations on both individual and the state regarding social and economic rights and duties. Not only the duties defined in the Constitution, but also internationally concluded agreements are important considerations when determining the scope and methods of delivery of the administration’s activities. Article 65 of the Constitution stipulates that the state shall fulfil its duties in the social and economic fields, as defined by the Constitution, to the extent of the adequacy of its financial resources, by observing the priorities appropriate to the aims of these duties. The rationale for this provision states that the criterion of adequacy of financial resources is a natural limit without straining the state’s existing resources and does not give anyone the right to demand that the state fulfill their social and economic rights. While the article states that the services assigned to the administration should be delivered according to the priorities appropriate to their aims, it does not specify a criterion /priority/ unity for public service, administrative police power, incentive and support, planning activities, or the subject and scope of these activities. It has states that the legislative body has discretion over which public services are to be performed and administered in accordance with public law procedures and which are to be performed and administered in accordance with private law procedures.
In this study, the financial resources of the administration will first be identified; the, it will be attempted to determine the criteria according to which the financing of services is determined and who covers the financing in the activities assigned to the administration as a duty under Turkish law. In this way, whether the administration uses economic theories when determining financing to provide services will be evaluated in the context of activities that have come before the courts. In this regard, the judicial body, in most cases before it, states that the legislature has discretionary power in determining the public interest in the activity. However, it also states that the administration’s provision of the activity is a constitutional obligation, that the most appropriate method among those providing the same benefit should be selected, that regulations should be made that do not disrupt the financial balance, that the administration should not be subjected to a serious burden, the absence of conflicting regulations between different tasks assigned to the administration in the same area in terms of the appropriateness of the activity to its purpose, and increasing the employment rate. However, matters such as maintaining a reasonable balance for those benefiting from the activity under economic burden, compliance with the principle of equality, and preventing the abuse of rights have been taken into account.
