Abstract

Industrial property law is subject to specific regulations and updates to these regulations because of its economic importance. As a result of need for progress, the Industrial Property Rights Act Number 6769 went into effect on January 01, 2017 and was published in the Official Gazette. One of the most controversial issues of the Act is the burden of using a trademark and the consequences of non-use, especially with regard to the Act's enforcement date. This article explores burden of use from an enforcement date perspective in accordance with the former Decree Law and Industrial Property Rights Act, and the new system contained in the Act is explained.
