Assessment on the Rights of Turkish Citizens After the Court of Justice of the European Union’s Soysal Judgment and Beyond

Abstract
In this study, rights of Turkish citizens in terms of Free Movement of Services with the perspective of “No Visa Europe” are elaborated on which is taken under consideration in terms of “Chapter 3; Right of Establishment and Free Movement of Services” within Turkey’s process of accession negotiations to the European Union. The current legal situation regarding rights of Turkish citizens are examined in this piece of work. In this context, the provisions in 1963 Ankara Agreement and 1970 Additional Protocol are of essential importance and it is determined that the judgments of the Court of Justice of the European Union are of basic guidance. In particular, the Court of Justice of the European Union landmark Soysal judgment and other judgments of importance are analysed in this scope. Relevant to the issue, the Re-admission Agreement is also taken into consideration which is pronounced together with the works in terms of the “Visa Liberalization Dialogue”; reflections on the rights of Turkish citizens with respect to the “No Visa Europe” are elaborated on. The article concludes that the main issue to ensure rights of Turkish citizens in the framework of Free Movement of Services relevant “No Visa Europe” is to increase consciousness about the issue and pursue necessary legal routes to defend rights.
Çalışmada, Türkiye’nin Avrupa Birliği üyeliği sürecinde devam etmekte olan katılım müzakerelerinde “Fasıl 3; İş Kurma Hakkı ve Hizmet Sunumu Serbestisi” altında ele alınmakta olan Hizmetlerin Serbest Dolaşımı konusunda “Vizesiz Avrupa” perspektifiyle, Türk vatandaşlarının hakları üzerinde durulmaktadır. Eldeki çalışmada, konu hakkında Türk vatandaşlarının haklarına ilişkin mevcut hukuki durum incelemektedir. Bu bağlamda, 1963 Ankara Antlaşması ve 1970 Katma Protokol hükümlerinin büyük rol oynadığı ve ayrıca, Avrupa Birliği Adalet Divanı kararlarının yol gösterici nitelikte olduğu tespit edilmektedir. Özellikle, Avrupa Birliği Adalet Divanı’nın konu hakkındaki “kırılma noktası” niteliğindeki Soysal Kararı ve sonrasındaki önem taşıyan kararları bu çerçevede ele alınmaktadır. Konuyla ilgili olarak, son dönemde “Vize Serbestisi Diyaloğu” bağlamındaki çalışmalarla birlikte dile getirilen Geri Kabul Antlaşması üzerinde de durulmakta; konunun Türk vatandaşlarının “Vizesiz Avrupa” kapsamındaki hakları açısından yansımaları da incelenmektedir. Bu çerçevede, Hizmetlerin Serbest Dolaşımı çerçevesinde “Vizesiz Avrupa” konusunda Türk vatandaşlarının haklarının sağlanması açısından temel hususun, konu hakkında farkındalığın artması ve hakların savunulması için gereken hukuki girişimlerin yapılması olduğu sonucuna varılmaktadır.
