The Effect of Irregularities in the Appointment of Judges on the Right to a Tribunal Established by Law: A Review of the Relevant ECHR Judgments

Abstract

The article examines the recent judgments of the ECHR regarding the right to a tri- bunal established by law. The article finds out the meaning given by the ECHR to the right to a tribunal established by law and briefly evaluates the Court’s jurisprudence. The guarantee of a tribunal established by law requires that the tribunal not only be established by law, but also conduct trials in accordance with the laws regulating the establishment and powers of the court. As stated by the ECHR Grand Chamber in its Ástráðsson decision, irregularities in the appointment processes of judges may, if certain conditions are met, lead to a violation of the right to a tribunal established by law in the rulings given by those judges. The ECHR developed the three-step test in the Ástráðsson judgment to determine in which cases irregularities in the appoint- ment of judges violate the right to a tribunal established by law and has consistently applied this test in its subsequent judgments. Accordingly, if (1) the alleged irregula- rities result from a manifest breach of domestic law, (2) the irregularities are so gra- ve that they undermine the essence of the right to a tribunal established by law, and (3) the allegations of irregularity have not been examined by domestic authorities in accordance with the jurisprudence of the ECHR, the right to a tribunal established by law is violated. The irregularities in question are not required to be directly rela- ted to the applicant’s case. Moreover, the ECHR decisions show that violation of this right may affect other substantive rights in the Convention.
Makale, AİHM’in, yasayla kurulmuş mahkemede yargılanma hakkına ilişkin yakın zamanda verdiği kararları incelemektedir. Makalede yasayla kurulmuş mahkeme hakkına AİHM’in verdiği anlam tespit edilecek ve Mahkeme içtihadının kısaca değerlendirmesi yapılacaktır. Yasayla kurulmuş mahkeme güvencesi, yargılamayı yapan mahkemenin yasayla kurulmasının yanında mahkemenin kuruluş ve yetkilerini düzenleyen yasalara uygun şekilde yargılama yapmasını da gerektirmektedir. AİHM Büyük Daire’nin Ástráðsson kararında ortaya koyduğu üzere, hakimlerin atanma süreçlerinde yaşanan usulsüzlükler bazı şartların gerçekleşmesi durumunda o hakimlerin bakmış olduğu davalarda yasayla kurulmuş mahkemede yargılanma hakkının ihlal edilmesine sebep olabilirler. AİHM, hâkim atamalarındaki usulsüzlüklerin hangi durumlarda yasayla kurulmuş mahkemede yargılanma hakkını ihlal ettiğini tespit için Ástráðsson kararında üç adımlı testi geliştirmiş ve sonraki kararlarında bu testi istikrarlı şekilde uygulamıştır. Buna göre, (1) iddia edilen usulsüzlük iç hukuktaki bir yasaya açıkça aykırılıktan kaynaklanıyorsa, (2) bu yasaya aykırılık yasayla kurulmuş mahkeme güvencesinin özüne zarar verecek kadar ağırsa, ve (3) usulsüzlük iddiaları iç hukukta AİHM içtihadına uygun bir şekilde incelenmemişse, yasayla kurulmuş mahkemede yargılanma hakkı ihlal edilmiş olacaktır. Söz konusu usulsüzlüklerin başvurucunun somut hukuki uyuşmazlığıyla doğrudan ilgisinin olması aranmamaktadır. Ayrıca, AİHM kararları göstermektedir ki bu hakkın ihlal edilmesi, AİHS madde 6/1 haricinde sözleşmedeki diğer maddi haklar bakımından da bazı etkiler doğurabilmektedir.
