506 sayılı Kanun’da olduğu gibi 5510 sayılı Kanun’da da sigortalı sayılmayanlar arasında işverenin ücretsiz çalışan eşi de sayılmıştır.
50 yılı aşkın süredir pek de üzerinde durulmayan bu düzenleme, somut olaydaki mağduriyet nedeniyle Anayasa’ya aykırılık iddiasına konu olmuştur. Nitekim eşine ait işyerinde yıllarca düzenli olarak çalışan kadın, eşi tarafından sigortalı yapılacağı söylenmesine
rağmen, sigorta bildiriminin yapılmadığını ileri sürerek hizmet tespiti davası açmıştır. İş mahkemesinin, ücretsiz çalışan eşin sigortalı
sayılamayacağı yolundaki kararının istinaf edilmesi üzerine Bölge Adliye Mahkemesi hükmün Anayasa’ya aykırı olduğu gerekçesiyle
Anayasa’nın 152. maddesi uyarınca, iptal talebiyle Anayasa Mahkemesi’ne dava açmıştır. Anayasa Mahkemesi, kanaatimizce isabetli
olmayan gerekçelerle çoğunluk oyuyla hükmün Anayasa’ya aykırı olmadığına karar vermiş ve böylelikle çok önemli bir fırsat kaçırılmıştır. Karara ilişkin ve çok doyurucu gerekçeler içeren dört adet karşıoy yazısı bulunmaktadır.
Aşağıda dava konusu olayın gelişiminin daha rahat anlaşılabilmesi için, İş Mahkemesi ve Bölge Adliye Mahkemesi kararlarına ve iptal
talebinin gerekçelerine yer verildikten sonra Anayasa Mahkemesi kararı alıntılanmıştır. Sosyal güvenlik hakkı ve eşitlik ilkesini çok
yakından ilgilendiren bu kararın değerlendirilmesine geçmeden önce, Anayasa Mahkemesi’nin somut norm denetimini nasıl yaptığına
ilişkin bilgi verilmiştir.

According to Code No. 5510 as well as Code No. 506 in Turkish Law, an employer’s spouse working free of charge is not deemed to be
an insurance holder. A short while ago, relevant provisions in the aforementioned codes, which have not been got enough attention for
more than 50 years, have been claimed to be unconstitutional and an application was lodged before the Turkish Constitutional Court
through the procedure of concrete review. In the concrete case, the woman, who worked regularly for her husband’s business, filed a
lawsuit claiming that she had been working for several years and her official registration as an insurance holder had not been made
at all. After the labor court ruled that the spouse working free of charge could not be considered an insurance holder, the Regional
Court of Justice filed a lawsuit to have the aforementioned provisions declared unconstitutional, pursuant to Article 152 of the Turkish
Constitution. In her judgment by majority vote, The Constitutional Court decided that these provisions are not unconstitutional.
In the article, this judgment is heavily criticized and in our view, an important opportunity to prevent injustice was missed. In order
to provide a better understanding of the development of the case, the decisions of the first instance court and the Regional Court of
Justice are detailed in the article. Also, the request and justifications for the concrete review put forward by the Regional Court of
Justice are included in the article. Before reviewing the judgment which is very closely related to the right to social security and the
principle of equality, basic information regarding the concrete review procedure is also given.
