Kurumsal Sürdürülebilirlik Politikaları Bağlamında Çevresel Talimatlara Aykırılığın İş Sözleşmesinin Feshi Açısından Değerlendirilmesi

Özet

Yaşanan iklim krizleri ve çevresel felaketler, yeşil dönüşümü ve kurumsal sürdürülebilirlik adımlarının atılmasını zorunlu hale getirmiştir. Devlet, bireyler ve diğer kuruluşların yanı sıra, işletmelerin de sürdürülebilirlik politikaları ekseninde aktif rol oynaması beklenmektedir. Ancak iş hukuku uygulamasında, işverenin yönetim hakkının “çevresel talimatları” kapsayıp kapsamadığı ve işçinin bu talimatlara aykırılığının haklı veya geçerli bir fesih nedeni oluşturup oluşturmayacağı tartışmalıdır. Bu bildirinin amacı; işverenin sürdürülebilirlik hedefleri doğrultusunda işçilere verdiği talimatlara aykırılık hallerinin, iş güvencesi ve fesih hukuku bakımından sonuçlarını incelemektir. Çalışmada öncelikle, işçinin iş görme ve sadakat borçlarının kapsamı irdelenecek; çevresel sürdürülebilirlik özelinde işverenin verdiği talimatların yönetim hakkı içindeki yeri tartışılacaktır. Akabinde, söz konusu ihlallerin ağırlığı değerlendirilerek, eylemin haklı mı yoksa geçerli bir fesih sebebi mi teşkil ettiği belirlenecektir. Çalışmanın sonucunda; çevresel talimatların hukuki niteliği tespit edilerek, bu ihlaller karşısında mahkemelerin “ölçülülük” ve “feshin son çare olması” ilkeleri bağlamında dikkate alması gereken denetim ölçütleri ortaya konulacaktır.

The ongoing climate crises and environmental disasters have necessitated the green transition and the implementation of corporate sustainability steps. In addition to the state, individuals, and other organizations, enterprises are also expected to play an active role within the axis of sustainability policies. However, in labour law practice, it is controversial whether the employer’s managerial prerogative encompasses “environmental instructions” and whether the employee’s non-compliance with these instructions constitutes a just cause or a valid reason for termination. The aim of this paper is to examine the consequences of non-compliance with instructions given by the employer in line with sustainability goals, within the context of job security and termination law.In this study, the scope of the employee’s duty to work and duty of loyalty will be examined primarily; and the place of the employer’s instructions specific to environmental sustainability within the managerial prerogative will be discussed. Subsequently, the gravity of the said violations will be evaluated to determine whether the act constitutes a just cause or a valid reason for termination. Consequently, by determining the legal nature of environmental instructions, the review criteria that courts should consider regarding these violations will be put forward in the context of the principles of “proportionality” and “termination as a last resort” (ultima ratio).
