Abstract
The development of technology has also shown its effect in transportation. Within this framework, airbags were first developed to protect the driver and passengers in possible accidents, followed by other technological developments such as speed tracking assistants, lane keeping assistants and parking assistants that facilitate the driver’s driving. Eventually, with the development of these systems, vehicles are now being produced where the driver is not in constant control, but where the driver's intervention is required in certain situations. These vehicles are called “autonomous vehicles”. With this vehicles, possible accidents on highways are tried to be prevented. However, there are changes in the way accidents occur due to new situations such as the control of these vehicles being transferred from the driver to the system and the driver being busy with other tasks while the vehicle is under system control. Therefore, new discussions are emerging at the point of determining the legal and criminal responsibilities of persons related to these vehicles, especially drivers. For this reason, amendments are being made to the laws regarding the use of autonomous vehicles in traffic and efforts are being made to solve possible legal problems in many countries. In this study, the legal debates and solutions that have emerged in the context of criminal law in relation to the issue will be discussed, and a suggestion will be made as to what kind of amendments can be made in the legislation of our country.
